Terms and conditions of participation in the 2023 Advent Calendar

  1. Participation in the Advent Calendar competition is free and voluntary. Your chances of winning do not change as a result of using a service and/or making a purchase. Switzerland Tourism, Morgartenstrasse 5a, 8004 Zurich is responsible for collecting and processing any personal data you provide in connection with the competition. Further information on how Switzerland Tourism processes your personal data can be found in section 10 and here.
  2. The Advent Calendar competition will take place exclusively online. It will go live from 12:00 a.m. on 1 December 2023 until 11:59 p.m. (GMT+1) on 24 December 2023 at www.myswitzerland.com/advent-calendar. The competition includes daily prize draws, a main prize and two special prizes. If participants are interested in one of the daily prize draws, they must register for that draw using the online registration form. The registration is only valid for the specific daily draw concerned. Participants do not need to take part in every daily prize draw. Participants are only allowed to complete the form for each prize once. In other words, they can only participate once. Participation in the daily prize draws is only possible on the relevant day from 12:00 a.m. to 11:59 p.m.
  3. The draw for the main prize will be held at the end of the competition. Every entrant who has taken part in at least one of the daily prize draws will automatically be entered into the main prize draw. All participants who have filled in the form to participate in the main prize draw will also be entered into the main prize draw. There will also be a draw for two special prizes. All participants who have completed the relevant forms during the competition period will be entered into the draw for the special prizes. Participants are only allowed to complete the form for each prize once. In other words, they can only participate once. By registering to take part, participants confirm their consent to these terms and conditions of participation.
  4. The daily prizes, main prize and special prizes are described in greater detail on the competition page. Participants will find detailed information on the daily prizes by opening the corresponding door in the Advent Calendar on the competition page. Entrants can also check the competition page for detailed information on the main prize. Detailed information on special prize no. 1 can de found on this page. Detailed information on special prize no. 2 can be found on this page. The prizes are valid until the date specified in the detailed description on the competition page and expire after this period.
  5. The winners will be randomly selected from the database of entrants within five working days of the competition closing date and subsequently contacted by e-mail. If a winner cannot be reached, or does not contact Switzerland Tourism within seven calendar days of being informed that they have won, Switzerland Tourism reserves the right to draw another winner. The winners of the daily prize draws will be published on a winners list on the competition page (for example Alain M. from Zurich). By taking part in a prize draw, participants consent to such publication.
  6. The competition is open to persons of legal age who are permanently resident in Belgium, Germany, England, France, Luxembourg, the Netherlands, Austria, Northern Ireland, Scotland, Switzerland and Wales. The winners will be drawn from all entrants. Any participation is irrelevant if it is excluded by law. There is no recourse to legal action. Multiple entries and entries by employees of Switzerland Tourism or its partners will not be accepted. Prizes are non-transferable and will not be paid in cash. Switzerland Tourism reserves the right to exclude entrants from the competition, delete multiple entries or abandon the competition if there are any discrepancies or suspicions of technical manipulation.
  7. Travel prizes are arranged directly between the winner and the competition partner, any warranty or liability on the part of Switzerland Tourism shall be excluded. Travel to and from the departure point of the journey (airport, railway station, etc.) shall be at the expense of the winner, unless stated otherwise in the competition description. The same applies for any costs incurred during the journey (minibar, etc.). The winners, and if applicable their companions, are responsible for ensuring that they have obtained everything necessary for the trip, in particular valid travel documents, any required visas, as well as any necessary health documents (medical certificates, vaccination certificates, etc.). Any taxes, fees or levies incurred in connection with the prize must be borne by the winner (with the exception of shipping costs, customs duties or import VAT).
  8. To the extent permitted by law, Switzerland Tourism shall accept no liability or responsibility whatsoever in connection with the competition, the organisation or redemption of prizes. In particular, Switzerland Tourism shall not be liable for technical outages of the competition page, including any network server or hardware errors, viruses, bugs, programming errors or other communication errors outside its direct control.
  9. Meta Platforms Inc. is not commercially or legally involved in this competition, even if the competition is advertised and shared on the Facebook and Instagram page of Switzerland Tourism and certain activities in connection with the prize take place on Facebook. The sole organiser of the competition is Switzerland Tourism. Any questions relating to the competition should be addressed to Switzerland Tourism crm@myswitzerland.com. By entering the competition and therefore accepting these terms and conditions of participation, entrants exempt Facebook from any liability and responsibility in connection with the competition.
  10. When they complete the registration form for participation in the daily prize draws as well as the main prize draw and the special prizes, entrants are prompted to provide certain personal details that will be transferred to Switzerland (title, first name, last name, e-mail address, country, language). This personal data is stored in Switzerland and used for the purpose of participating in the competition and the realisation of the competition. By entering the prize draw, entrants agree that Switzerland Tourism may use the e-mail address they have provided for the purposes of sending a satisfaction survey after the competition has ended.
    The entrants’ personal data will only be transferred to third parties insofar as this is required in order to run the competition and administer the prize.
    Switzerland Tourism will make every effort to ensure that third parties only process personal data to the same extent permitted for Switzerland Tourism. By participating in the prize draw, entrants agree to the processing of the corresponding personal data for the above-mentioned purposes. Entrants may revoke their consent at any time. In the event of cancellation, participants are no longer entitled to take part in the prize draw.

  11. The competition shall be governed by Swiss law. For any disputes in connection with the competition or these terms and conditions of participation, the courts of Zurich shall have exclusive jurisdiction. Notwithstanding the above, any mandatory protective regulations for consumers residing in Germany shall remain unaffected.
    Accordingly, any mandatory protective regulations applicable for consumers residing in other EU countries shall also remain unaffected.
  12. There is always a risk of accident or sickness involved when participating in the competition. In addition to the current acute risk of becoming infected with COVID-19, there is also the risk that participants will have to go into quarantine if another person participating in the event or trip, or a third person with whom the participant has come into contact, tests positive for COVID-19.
    In addition to the health-related risks, there is also a risk of losses being incurred, such as those listed below:
    • Medical treatment costs
    • Hospitalisation costs
    • Repatriation costs
    • Personal expenses, costs, inconvenience and long-term losses
    • Additional accommodation or travel costs
    • Cancellation costs
    • Losses due to quarantine, in particular loss of salary or earnings.

    Individuals who participate in the competition and redeeming the prize do so at their own risk. Participants are advised to insure themselves against such risks.

    To the extent permitted by law, Switzerland Tourism expressly excludes any liability for losses incurred by the participant due to participation in such events and trips.
    Switzerland Tourism also reserves the right to change or cancel informational and
    promotional events even at short notice, and is expressly entitled to do so, if Switzerland Tourism deems this appropriate due to the risk situation. The authority to implement a change or annulment at short notice also relates to this competition.
    The entrant hereby acknowledges and agrees to this liability disclaimer on the part of Switzerland Tourism. The entrant waives all claims for compensation against Switzerland Tourism, except where damages were caused deliberately or by gross negligence.
    Neither Switzerland Tourism nor the tourism destination shall be liable if the trip cannot take place due to COVID-19, or for any other reason.
